Terms and Conditions

1. Acceptance of Terms

Welcome to MiM. These Terms and Conditions (“Terms”) govern your access to and use of the MiM platform, including our website, applications, and all related services (collectively, the “Platform”). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

We are Aesir Technology LTD, doing business as MiM (“Company”, “we”, “us”, or “our”), a company registered in England at 3rd Floor, 86–90 Paul Street, London EC2A 4NE. We operate the website trymim.com and any related products and services that refer or link to these Terms.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Effective date” above, and where practicable by notifying you via email. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

2. Definitions

Throughout these Terms, the following definitions apply:

  • MiM (“we”, “us”, “our”): Aesir Technology LTD, the company operating the Platform.
  • Creator: A user who offers fashion and style services through the Platform via their Studio.
  • Fan: A user who discovers, books, and pays for Creator services.
  • Studio: A Creator’s public-facing profile and storefront on the Platform, accessed via a unique handle (e.g., @handle).
  • Service: A bookable offering listed by a Creator, which may include asynchronous deliverables (e.g., style guides, curated shopping lists) or live sessions (e.g., video consultations).
  • Request: An instance of a booked Service between a Fan and a Creator, encompassing all stages from intake to delivery.

3. Age Requirement

You must be at least 16 years old to create an account or use the Platform. By registering, you represent and warrant that you meet this age requirement. If we become aware that a user is under 16, we will terminate their account and delete any associated personal data in accordance with our Privacy Policy.

4. Account Registration and Responsibilities

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, complete, and current information during registration.
  • Maintain the security and confidentiality of your login credentials.
  • Notify us immediately of any unauthorised access to or use of your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate any account that violates these Terms or that we reasonably believe is being used fraudulently. We may also remove, reclaim, or change a username if we determine, in our sole discretion, that it is inappropriate, obscene, or otherwise objectionable.

5. Platform and Marketplace Disclaimer

MiM is a technology platform and marketplace that connects Creators with Fans. MiM does not provide style advice, endorse any Creator’s qualifications or credentials, or guarantee the quality, accuracy, suitability, or outcome of any Service or advice provided by Creators.

The relationship formed when a Fan books a Service is between the Fan and the Creator. MiM is not a party to this relationship and accepts no liability for the acts, omissions, advice, or content of any Creator. Fans acknowledge that they act on Creator advice entirely at their own risk and should exercise their own judgement before making purchasing decisions or changes to their appearance based on Creator recommendations.

Creators are independent contractors and not employees, agents, or representatives of MiM.

6. Services and Marketplace Conduct

Creators agree to:

  • Provide accurate descriptions and pricing for their Services.
  • Fulfil Requests in a timely and professional manner.
  • Communicate with Fans respectfully and in good faith.

Fans agree to:

  • Provide truthful and complete information when completing intake stages.
  • Communicate with Creators respectfully and in good faith.
  • Not misuse the Platform to obtain Services without intent to pay.

7. Payments and Commissions

All payments on the Platform are processed through Stripe, our third-party payment provider. By using the Platform, you agree to Stripe’s Terms of Service and Privacy Policy.

MiM charges a commission on each completed Request. The default commission rate is 20% of the Service price. This rate may vary and will be clearly communicated to Creators in their account settings. Creators receive the remaining balance after commission and any applicable payment processing fees.

Fans are charged at the time of booking. MiM holds funds and releases payment to the Creator upon satisfactory completion of the Request, in accordance with the Service workflow. Pricing is set by the Creator and displayed in the currency specified by the Creator.

8. Moderated Payment Delay

To ensure service quality and allow time for dispute resolution, MiM enforces a moderation window between the time a Creator marks a Service as complete and when payment is released. During this window (currently set to 2 days), Fans or Creators may raise concerns for review.

MiM reserves the right to adjust the length of this moderation window at any time. Payments will only be processed after this window has passed and no disputes are pending. MiM is not liable for delays due to dispute resolution or account review.

9. Disputes and Refunds

MiM reviews disputes between Fans and Creators on a case-by-case basis. If a dispute arises regarding a Request, either party may raise a complaint through the Platform’s dispute resolution process.

MiM may, at its sole discretion, issue full refunds, partial refunds, or platform credits to resolve disputes. Neither party is automatically entitled to a refund except where explicitly stated in these Terms (see Section 12, Content Violation Consequences). We encourage both parties to attempt to resolve issues directly before escalating to MiM.

10. Affiliate Links and Third-Party Products

Creators may include links to third-party retailers within their Service deliverables. MiM and/or Creators may earn a commission on purchases made through these links.

MiM does not endorse, warrant, or accept any liability for third-party products or services linked from the Platform. Fans are responsible for reviewing the terms, pricing, and return policies of any third-party retailer independently. Any transaction with a third-party retailer is solely between the Fan and that retailer.

11. Prohibited Content and Conduct

The following are strictly prohibited on the Platform:

  • Inappropriate, offensive, discriminatory, harassing, threatening, or sexually explicit text, images, video, or other media.
  • Content that infringes upon the intellectual property rights of any third party.
  • Fraudulent, deceptive, or misleading conduct.
  • Attempts to circumvent Platform fees by arranging payment outside the Platform, including promoting or linking to external services that bypass MiM’s commission system.
  • Sharing or soliciting personal contact information to arrange services off-platform.
  • Impersonation of another person or entity.
  • Uploading or transmitting viruses, malware, or other material that interferes with the Platform’s operation.
  • Using automated systems (bots, scripts, scrapers) to access the Platform without written permission.
  • Providing misleading or AI-generated responses represented as personal advice.
  • Any activity that violates applicable laws or regulations.

MiM reserves the right to review any content or communication reported by users and to take action at its sole discretion, including content removal, warnings, or account suspension or termination.

12. Content Violation Consequences

Where MiM determines that a user has violated Section 11 (Prohibited Content and Conduct), the following consequences apply:

  • Fan violations: The Fan’s account may be suspended or terminated. No refund will be issued for any active or completed Requests.
  • Creator violations: The Creator’s account may be suspended or terminated. A full refund will be issued to the affected Fan for the relevant Request(s).

MiM’s determination of a violation is made at its sole discretion and is final. Repeated or severe violations may result in permanent account termination.

13. Content Confidentiality

Users and Creators may not copy, share, repost, or distribute any private content, images, messages, or personal information exchanged through MiM without the other party’s explicit consent. This obligation applies during and after the use of the Platform.

Violation of this section may result in account suspension or termination and may give rise to legal action by the affected party.

14. AI-Assisted Features

MiM may use artificial intelligence (“AI”) models and automated systems to assist Creators in producing content and delivering Services. This may include, but is not limited to, generating style recommendations, assisting with deliverable creation, and improving the overall platform experience.

In connection with these features, Fan inputs (including style preferences, body measurements, photographs, and questionnaire responses) and Creator-generated content (including style guides, recommendations, and media) may be processed by AI systems, including third-party AI service providers.

By using the Platform, you consent to such processing. Where applicable law requires, we will seek your explicit consent before processing your data through AI systems. You may opt out of AI-assisted processing where applicable by contacting us at the details provided in Section 28. Please note that opting out may limit the availability of certain features.

AI-generated outputs are provided as suggestions only and do not constitute professional advice. Creators remain responsible for reviewing and approving all content before it is delivered to Fans.

15. Session Recording

MiM may record live video sessions between Creators and Fans for the purposes of dispute resolution, quality assurance, and platform safety. By participating in a live session, both parties consent to the recording of that session.

Recordings are stored securely and retained in accordance with our Privacy Policy. Access to recordings is restricted to authorised MiM personnel and will only be reviewed where necessary (e.g., to investigate a reported dispute or policy violation).

16. Intellectual Property

We are the owner or the licensee of all intellectual property rights in our Platform, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”). Our Content and Marks are protected by copyright and trademark laws and treaties around the world.

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Platform and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use. No part of the Platform, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission.

Any breach of these intellectual property rights will constitute a material breach of these Terms and your right to use the Platform will terminate immediately.

17. User Content Licence

By submitting content to the Platform (including text, images, video, and other media), you grant MiM a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute such content solely for the purpose of operating and promoting the Platform. You retain ownership of your content.

You represent and warrant that you have all necessary rights to the content you submit and that your content does not infringe the rights of any third party.

18. Promotional Use of Public Creator Content

By creating a public profile on MiM, you grant MiM a non-exclusive, royalty-free, worldwide licence to use your name, image, biography, and other publicly visible content for marketing and promotional purposes related to the Platform. This includes, but is not limited to, use on the MiM website, social media channels, emails, presentations, and advertising.

You may request removal of specific content from future promotional use by contacting us at the details provided in Section 28.

19. Taxes and Income Reporting

Creators are independent service providers and are solely responsible for reporting and paying any applicable taxes on income earned through MiM. MiM does not provide tax advice, withhold income taxes, or issue tax filings on behalf of Creators.

It is your responsibility to comply with your local tax laws, including but not limited to income reporting, VAT, self-employment tax, and national insurance contributions. You agree to indemnify MiM against any claims arising from your failure to comply with your tax obligations.

20. Disclaimer of Warranties

The Platform is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Platform and your use thereof, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranties or representations about the accuracy or completeness of the Platform’s content and we assume no liability or responsibility for any: (a) errors, mistakes, or inaccuracies of content; (b) personal injury or property damage resulting from your access to and use of the Platform; (c) any unauthorised access to or use of our servers and/or any personal or financial information stored therein; (d) any interruption or cessation of transmission to or from the Platform; or (e) any bugs, viruses, or similar harmful components transmitted through the Platform by any third party.

21. Limitation of Liability

To the maximum extent permitted by applicable law, MiM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to:

  • Loss of revenue, profits, or business.
  • Loss of data or content.
  • Any action taken or not taken based on Creator advice or AI-generated content.
  • Any dispute between a Fan and a Creator.
  • Any transaction with a third-party retailer.

Our total aggregate liability for any claim arising from or related to these Terms or the Platform shall not exceed the lesser of: (a) the amount you paid to MiM in the six (6) months preceding the event giving rise to the claim; or (b) £100.

22. Indemnification

You agree to indemnify and hold harmless MiM, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit to the Platform; or (e) any overt harmful act toward any other user of the Platform. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us.

23. Termination

You may close your account at any time by contacting us or through your account settings. MiM may suspend or terminate your account at any time and for any reason, including but not limited to violation of these Terms.

In the event of termination for content violations (Section 12), the refund and consequence provisions of that section shall apply. For all other terminations, any outstanding payments owed to Creators will be processed in accordance with the normal payment schedule, and any pending Requests may be cancelled at MiM’s discretion.

If we terminate or suspend your account, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.

Sections that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) shall survive.

24. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Platform at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Platform without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Platform.

We cannot guarantee the Platform will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Platform during any downtime or discontinuance.

25. Electronic Communications

Visiting the Platform, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Platform, satisfy any legal requirement that such communication be in writing.

26. Governing Law

These Terms are governed by and interpreted following the laws of England and Wales. If your habitual residence is in the EU and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law of your country of residence. Aesir Technology LTD and yourself both agree to submit to the non-exclusive jurisdiction of the courts of London, which means that you may make a claim to defend your consumer protection rights in regards to these Terms in England, or in the EU country in which you reside.

27. Miscellaneous

These Terms and any policies or operating rules posted by us on the Platform constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.

We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control (force majeure).

There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Terms or use of the Platform.
